1. Our obligations
1.1 Registration and Provision of Service
Access to and use of some OnMedica services will be conditional on you meeting certain criteria, such as your qualifications and length of qualification. OnMedica reserves the right, at its discretion, to introduce new criteria and to change any criteria from time to time. 

The Website is provided on an "as is" basis. Some content is made accessible to eligible registered members only. Wilmington Healthcare Ltd reserves the right to make changes to the Platforms(s) and/or content at any time, and without notice.

1.2 Data Protection
To ensure that we are meeting our legal obligations relating to current data protection legislation in the UK (including General Data Protection Regulations (GDPR) we will need to validate the professional contact details that you provide to us on a regular basis. If at any time, we are unable to validate your information in relation to your professional role, then membership, associated communications and access to content may be interrupted. By registering with OnMedica you are giving your ‘expressed and individual’ consent to allow us to hold your professional details on the Wilmington Healthcare Ltd* database for the purposes stated below (1.3 Use of Personal Data). You may opt-out from the Wilmington Healthcare Ltd database at any time by following the unsubscribe links in emails, emailing validate@wilmingtonhealthcare.com. You understand that by unsubscribing your membership of OnMedica may be invalidated and your access to member-only content on OnMedica will be restricted. For more information about your rights, please refer to our privacy policy.

*OnMedica is a brand owned by Wilmington Healthcare Ltd.

1.3 Use of Personal Data
Wilmington Healthcare Ltd is the data controller (registration number Z5180243) of your personal details for the purposes of the General Data Protection Regulations GDPR. We may collect the following types of information about you:

  • Information you provide at registration or by subsequently changing and/or validating your professional details held on the Wilmington Healthcare Ltd database (including consents and preferences)
  • Records of correspondence you have with us by letter, email or telephone, survey responses that you may complete through our Platforms or in response to email communications from us and our sponsored/licenced third-parties
  • Details of your visits to the site and resources that you access, including information you may wish to have stored to personalise your use of the site (such as links or topics of interest)
  • Records of your comments made on site content and discussion forum postings.
  • Information about your computer, including where available, such as IP address, operating system and web browser used.
These personal, professional details may be used by us or on behalf of other third parties including pharmaceutical companies who we are working with to:
  • Administer the Website, notify you about changes to our service or allow you to participate in interactive features of our services where you choose to do so
  • Make available to you, online, by email or by mail, educational and promotional information that may be relevant to your professional role, either from Wilmington Healthcare organisations or selected third-parties working in healthcare
  • Conduct market research and analysis relating to the delivery and/or improvement of healthcare services and patient care
  • Invite you to take part in studies, attend or speak at events, be part of a media or other panel or contribute to content
  • Report an adverse drug reaction that you may have posted on the site (See section 1.4)
  • Send regulatory communications relating to drug safety or product updates, or report on transfer of value

Our internal working practices also ensure your privacy is protected by limiting employee access to the data. Professional data is only shared with selected third-parties involved in the delivery of healthcare services and/or patient care, and under a strict licence that permits use only for a specified and agreed purpose and terms.

1.4 Adverse Drug Report
Wilmington Healthcare Ltd may be obliged under the provisions of the Medicines Acts and the ABPI Code of Practice to inform pharmaceutical companies of reports of adverse reactions to any of the companies products that a medically qualified person(s) may post on this site. OnMedica will be obliged, under these provisions, to identify the reporter to the pharmaceutical product licence holder so that the licence holder may make further enquiries by telephone or in writing concerning such reports. However, identifying detail will not include your email address. The information given will be exactly as it is reported.

2 Your obligations
2.1 Correct Information

The professional information that you supply to us for the purpose of registration and validation is true and correct. Membership to OnMedica is reliant on having i) up-to-date and validated professional contact information, including a valid email address. This is because parts of the service are delivered via email. Out-of-date or incorrect information may result in membership of the OnMedica being suspended or withdrawn, or access to member-only content being blocked.

2.2 Safeguarding of Password
You will not make your password available to any third party.

2.3 Distribution of Information
You will not distribute or make available any content of the Website to any third parties who are not members without the express written permission of Wilmington Healthcare Ltd. If you wish to share content with non-members then please contact us in the first instance.

2.4 Obscene or Inflammatory Language
When corresponding with us or any of our members or when posting any comments on the Website you will not use any obscene or inflammatory language, promote or exhibit sexually explicit materials, promote violence or other illegal activities including but not limited to discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.

2.5 Copyright
You are permitted to print or download some of the material or information displayed on the Website for your personal use, but you may not republish any substantial part of the data in any form without our prior written permission. You acknowledge that the printing or downloading of some of the sections of the Website is strictly prohibited and you are referred to the individual copyright statements displayed on such sections.

Your postings to the Website and communications with other users will not infringe any third parties' copyright or other intellectual property rights.

3 Our rights
3.1 Obscene or Inflammatory Postings
We have the right to remove all obscene or inflammatory postings and all other postings that violate your duty set out in 2.4 above at any time and without further notification to you.

3.2 Withdrawal of Password
We have the right to bar you from using the Website by withdrawing your password at any time and without prior notification, if you violate any of the rules contained in these Terms and Conditions.

3.3 Right to Amend These Terms
We reserve the right to add to and change the terms of this agreement at any time.

4 Disclaimer
4.1 Products of Third Parties

We do not act as agents for and can give no assurances with regard to the persons, companies and other organisations whose goods and services are displayed or referred to on the Website, nor with regard to the availability, suitability, fitness for purpose or prices of such goods or services. We do not endorse or recommend any of these goods or services and no liability is accepted by us in this respect.

4.2 Content
Whilst considerable efforts are made to ensure that the information contained in the Website and Mobile Applications is of the highest quality and accuracy, no warranty in relation to such information is given or shall be implied. We cannot accept responsibility or liability for any content, advice or opinions displayed on the Website and Mobile Applications, including those that are used in the diagnosis or the treatment of patients. In particular, you recognise that the information and material contained in the Website and Mobile Applications is to be used only as a reference aid and is not intended to be a substitute for the exercise of your own professional judgement.

To the fullest extent permitted by law we exclude liability for damages arising out of or in connection with the use of the Website and Mobile Applications. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. For the avoidance of doubt we do not limit our liability for death or personal injury where the same arises as a result of our negligence.

4.3 Clinical Material
The clinical information contained on this site is the responsibility of the authors.

Wilmington Healthcare Ltd and its officers, employees, directors, agents, successors and assigns do not accept any responsibility for the content, accuracy or quality of the clinical information provided on this site, or any liability for any direct, indirect or consequential loss, damage or liability of whatever kind or nature incurred by anyone accessing or using the information. Notwithstanding this, in accessing the information, visitors to the site agree to waive any claim, demand, lien, action, suit or cause of action arising from the use of the information, which they now have or may have in the future against Wilmington Healthcare Ltd.

5 Applicable law
5.1 Products of Third Parties
These terms and conditions are governed by and will be interpreted in accordance with the laws of England and Wales to the exclusive jurisdiction of the Courts of which countries the parties agree to submit.
