1 Our guarantees

1.1 Registration and Provision of Service

We will provide you with a password, which will allow you to access the Website. The Website is provided free of charge on an "as is" basis.

1.2 Unsolicited Communication

We will not transmit to you any unsolicited communication whether by electronic mail or any other means unless you have agreed to receiving such communication by leaving ticked the OnMedica emails box on the registration form. You may also opt-out of receiving email communications from OnMedica Group at any later time.

1.3 Site Security

At OnMedica Group we are extremely aware of the importance of privacy and security throughout our Website and are committed to protecting our users. We undertake to adhere to British Medical Association (BMA) and Association for the British Pharmaceutical Industry (ABPI) guidelines on Internet security and any future recommendations will be incorporated where applicable. The site is hosted on our own servers. No unauthorised person has access to the machines or the software.

1.4 Third Party Communication

Your password, username and/or email address will not be given or sold to any third parties for use in direct mail or any other activities, other than to selected third parties providing specialist administrative services to OnMedica Group, acting as agents on our behalf and with no rights to use your email address for any purpose whatsoever except on our behalf as allowed under these Terms and Conditions. Other user details may only be made available to third parties for certain specified purposes, in accordance with our Data Protection Act 1998 registration and you will always be given the opportunity to prevent OnMedica from sharing any personally identifiable data about your use of the Website with third parties, except in the case of adverse drug reacton reports posted on the site (see Section 1.7).

1.5 Privacy of Your Personal Data

OnMedica Group Ltd is the data controller of your personal details for the purposes of the Data Protection Act 1998. We may collect the following types of information about you:

  • information you provide at registration or by subsequently changing your registered details

  • records of correspondence you have with us by letter, email or telephone, surveys that you may complete through the Website or in response to email communications from us

  • details of your visits to the site and resources that you access, including information you may wish to have stored to personalise your use of the site (such as links or topics of interest)

  • records of your comments made on site content and discussion forum postings.

These personal details may be used by us or other 3rd party providers who we are working with to:

  • administer the Website

  • conduct market research and analysis

  • make available to you educational and promotional information that may interest you

  • allow you to participate in interactive features of our service where you choose to do so

  • notify you about changes to our service

  • report an adverse drug reaction that you may have posted on the site (see Section 1.7)

Our internal working practices also ensure your privacy is protected by limiting employee access to the data.

1.6 Use of Cookies and IP Addresses

OnMedica Group will use only 'first-party' cookies, which are not transmitted to any third party, to facilitate your use of this Website. Cookies are used to keep track of your participation in the OnMedica Points and OnMedica Gold reward schemes, and to remember your username for login (both optional). Cookies are also used to maintain your session and allow us to record your activities (such as progress through an educational course) and to keep track of your preferences. These session cookies are not stored on your computer after the browser session is completed. If you disable or restrict cookies, you may not be able to use our Website.

We may collect information about your computer, including where available, such as IP address, operating system and web browser used.

1.7 Adverse Drug Reports

OnMedica Group may be obliged under the provisions of the Medicines Acts and the ABPI Code of Practice to inform pharmaceutical companies of reports of adverse reactions to any of the companies products that a medically qualified person(s) may post on this site. OnMedica will be obliged, under these provisions, to identify the reporter to the pharmaceutical product licence holder so that the licence holder may make further enquiries by telephone or in writing concerning such reports. However, identifying detail will not include your email address. The information given will be exactly as it is reported.

2 Your obligations

2.1 Correct Information

The information that you supply to us for the purpose of registration is true and correct.

2.2 Safeguarding of Password

You will not make the password with which we supply you available to any third party.

2.3 Distribution of Information

You will not distribute or make available any content of the Website to any third parties who are not members of a primary healthcare team.

2.4 Obscene or Inflammatory Language

When corresponding with us or any of our members or when posting any comments on the Website you will not use any obscene or inflammatory language, promote or exhibit sexually explicit materials, promote violence or other illegal activities including but not limited to discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.

2.5 Copyright

You are permitted to print or download some of the material or information displayed on the Website for your personal use, but you may not republish any substantial part of the data in any form without our prior written permission. You acknowledge that the printing or downloading of some of the sections of the Website is strictly prohibited and you are referred to the individual copyright statements displayed on such sections.

Your postings to the Website and communications with other users will not infringe any third parties' copyright or other intellectual property rights.

3 Our rights

3.1 Obscene or Inflammatory Postings

We have the right to remove all obscene or inflammatory postings and all other postings that violate your duty set out in 2.4 above at any time and without further notification to you.

3.2 Withdrawal of Password

We have the right to bar you from using the Website by withdrawing your password at any time and without prior notification, if you violate any of the rules contained in these Terms and Conditions.

3.3 Right to Amend These Terms

We reserve the right to add to and change the terms of this agreement at any time.

4.1 Products of Third Parties

We do not act as agents for and can give no assurances with regard to the persons, companies and other organisations whose goods and services are displayed or referred to on the Website, nor with regard to the availability, suitability, fitness for purpose or prices of such goods or services. We do not endorse or recommend any of theses goods or services and no liability is accepted by us in this respect.

4.2 Content of the Website

Whilst considerable efforts are made to ensure that the information contained in the Website is of the highest quality and accuracy, no warranty in relation to such information is given or shall be implied. We cannot accept responsibility or liability for any content, advice or opinions displayed on the Website, including those that are used in the diagnosis or the treatment of patients. In particular, you recognise that the information and material contained in the Website is to be used only as a reference aid and is not intended to be a substitute for the exercise of your own professional judgement.

To the fullest extent permitted by law we exclude liability for damages arising out of or in connection with the use of the Website. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. For the avoidance of doubt we do not limit our liability for death or personal injury where the same arises as a result of our negligence.

4.3 Clinical Material

The clinical information contained on this site is the responsibility of the authors.

OnMedica Group and its officers, employees, directors, agents, successors and assigns do not accept any responsibility for the content, accuracy or quality of the clinical information provided on this site, or any liability for any direct, indirect or consequential loss, damage or liability of whatever kind or nature incurred by anyone accessing or using the information. Notwithstanding this, in accessing the information, visitors to the site agree to waive any claim, demand, lien, action, suit or cause of action arising from the use of the information, which they now have or may have in the future against OnMedica Group.

5.1 Products of Third Parties

These terms and conditions are governed by and will be interpreted in accordance with the laws of England and Wales to the exclusive jurisdiction of the Courts of which countries the parties agree to submit.
